Transaction – Item natures

 

a)       Nature of the items

 

The items sold at Hidepark21 can be of two sorts:

First sort:Immaterial items (also referred to as virtual or even abusively as electronic items) – by which denomination is meant that NO material articles (like books, CDs, DVDs etc.) are to be provided. These documents are accessed to by our customers through a network connection; therefore these products are submitted to no additional shipping-fee.

Second sort: Material items (also referred to as physical items) – by which denomination is meant that the item has a material nature for example CDs, DVDs, and al. and is thus likely to be submitted to an additional shipping-fee.

 

b)        Explicit reference to material articles

 

Physical items are clearly and systematically identified by their category (book, CD, DVD, etc.) and subjected to specific sales conditions detailed in the relevant shipping section.

All non-specifically identified articles are therefore necessarily of an immaterial nature.

It is always possible, although we try to avoid such occurrences, that in the description of a piece of writing the mention "this paper" or "the paper" or "a paper by..." and alike should appear. It is not to be regarded as a sign of the article being a material article but only a common abuse of language quite difficult to avoid when referring to a piece of writing.

Books, reviews, newspapers, in a word all pieces of writing sold in which so ever paper format shall always be identified with the relevant mention (for instance: "book", "review", or "newspaper") next to its title. Should no such mention appear, the piece of writing shall always be delivered in a virtual setting only. So with music productions: CDs, DVDs are explicitly identified.

 

Transaction – General Conditions

 

a)       Personal utilisation licence

 

When purchasing a piece of writing, a song, a picture or any other object protected by intellectual property regulations, our customer should be aware he does not buy this work but eventually purchases a personal utilisation licence for the considered piece of creation. And so eventhough there might be a material information-holder bought at the same time (like a book, a CD or a DVD). This licence includes the right to an original access to this work, the right to save the document in any format of our customer's choice, the right to utilise it as many times as he or she wishes for his own satisfaction and finally the right to make as many copies as he wishes for his personal use only.

On the contrary, the following activities: copying for other purposes than personal usage, proceeding to public performance(s) or broadcasting, or any other transaction with a third party implying the item(s) purchased on Hidepark21 website are strictly forbidden and should constitute in case of their taking place a criminal offense to be prosecuted by us in front of the adequate court.

 

b)       Preservation of the item

 

Our customer is responsible for the preservation of the article(s) (either material or electronic) he has purchased. Hidepark21 Publications are not liable to restore an article which has already been delivered or accessed to but which was accidentally lost by our customer. An exception to this principle arises for electronic items when our customer is registered in our Premier Client listing. He then benefits from such a protection against accidental loss (See appendix A, Premier Clients' Priviledges).

 

c)       Price

 

The applicable price is the price indicated in the payment page which ought to be the same as the one in the description page. Please report any although unlikely always possible mistake to: sales@hidepark21.org. The currency in which the price is expressed is the US Dollar and it appears as a prefix, namely the following: 'US$' or only '$'. For instance both 'US$4.50' and '$4.50' indicate a price of four US-Dollars and fifty cents. The sign '.' indicates the separation between Dollars and cents, the sign ',' denotes thousand multiples so that US$ 4,000.00 depicts a price of four thousand US Dollars.

 

Transaction – Paypal® payments

a)       Payments and access to the item

 

Hidepark21 Publications uses the services of Paypal® to receive payments for its articles. Paypal® is an independent company belonging the Ebay group which offers financial services to Web-based companies such as Hidepark21 Publications. Your clicking on buttons like the "buy it now!" button, "make a donation!" or "add to your cart" will lead you to a Paypal® SSL secured pages where you will operate your payment for the selected item(s) onto the Paypal® account of Hidepark21. This service provider guarantees you and us the best commercially available degree of securization for our financial transaction. For more detail about Paypal® SSL Securization please see Paypal's information pages. www.paypal.com. Please note that you do NOT need to have a registered account at Paypal® to proceed payments . You can use your credit card – both Visa- and Mastercards are accepted. Of course if you have such an account, it may be used to pay. In all cases, you will just have to follow the instructions on the Paypal® pages to complete your payment.

Once your payment is successfully processed, Paypal® will notify it to us. Please note that you will be sent procedures on how to access to your item(s) only once your payment has been notified to us by Paypal®.

 

e)       Troubleshooting

Appendix A – Premier Clients' Priviledges

a)       Your rights protected...

 

As a Premier Client you benefit from a guarantee of your rights which means that by registering we get to know you as one of our Premier Client and nobody can claim that you do not own the licence for the titles which you have registered for.

 

b)       Protection against accidental losses...

 

Should you accidentally lose an electronic document for which you have a registred licence (for instance by accidentally erasing the file on your hard-disk or damaging the removable support on which it was saved),  it would be replaced up to five times free of charge. Beyond this limit (if you lose it more than five times), the licence is lost.
